G2C & G2G app for the various lease sanctioned by the GoHP to general public for various purposes.
To attract private investment in HP and to boost industrial expansion, tourism, Hydro power projects, Educational Institutions, Petrol Pumps, Gas Godowns, Landless, construction of residential house by the landless Bonafide Himachali or for the rehabilitation of sufferers of natural calamities etc. the state government allocate land on lease. The land may be granted on lease for the purpose and to persons as provided under Himachal Pradesh Ceiling on Land Holdings Act, 1972 (Act No.19 of 1973) and the Himachal Pradesh Village Common Lands Vesting and Utilization Act, 1974 (Act No. 18 of 1974)
Leaseholders, after getting approval of the State Government, enter into agreement to manage, operate and maintain the leased property for the purpose for which it has been leased out.
With the help of this app citizens can see the details of the lease sanctioned description of land, its expiry, lease payment, lease pending payments etc.
The District Administration monitors the various sanctioned leases with respect to payments, expired leases, period for which the leases have been sanctioned and purpose of the leases. In manual system it is very difficult to monitor these lease cases on day to day basis. To overcome this app has been proposed to monitor the status of all types of leases.
The e-Patta(lease) has been proposed to facilitate District Administration, citizens, industrialists & business houses. This app will be used to view/search data of the lease holders of the various locations of the District. The various detail about the lease details may be viewed with various parameters like expiry of lease, purpose wise number of lease sanction, to check Lease payment status, Details of the land leased, Maximum number of years’ wise details for which lease has been granted.
The land may be granted on lease for purposes and to persons as provided under rules with the sanction of the competent authority, out of land vested with the State Government under Section 3 of the HP Village Common Lands Vesting and Utilization Act, 1974 (Act No. 18 of 1974) or the land vested under section 11 of the HP Ceiling on Land Holdings Act, 1972 (Act No. 19 of 1973), in the interest of the development of the State, if the State Government is satisfied that there are sufficient reasons to do so.
The lease may be granted only in the interests of the development of State, if the State Govtis satisfied that there are sufficient reasons to do so. The development of State shall include the following purposes, namely:— (i) educational Institutions; (ii)petrol Pumps and/or gas godowns (iii) self-employment of Ex-servicemen, war widows, Below Poverty Line families and differently abled persons.
Maximum limit to sanction lease shall be as certified by the Department concerned dealing with the subject under the Business of the GoHP (Allocation) Rules, 1971 in the shape of Essentiality Certificate on Form C and the same shall be subject to the provisions of Himachal Pradesh Ceiling on Land Holdings Act, 1972 (Act No. 19 of 1973).
On receipt of the application, complete in all respect under sub-rule (1), the District Collector shall examine the same and if he is of the opinion that the application should be accepted, he shall recommend the same to the Divisional Commissioner, concerned within a period of 30 days from the date of receipt. The DC shall ensure that all relevant information and documents, specified in Form A, are available and in order before making recommendation. If documents are not in order, he shall return the application to the person concerned with a specific order.
When a lease has been sanctioned by the competent authority, the Collector shall execute a lease in Form-B within a period of 6 months from the sanction of lease by the Competent authority. Possession of the land shall not be given to the applicant until the lease has been registered.
